Dispute Resolution Through Mediation
Litigation in our society and in our businesses continues to increase at a dramatic rate. When people work together there is bound to be conflict and organizations should have a plan in place to deal with disagreements in a prompt and fair manner. Companies are looking for more flexible and less costly methods to settle disputes and avoid the high cost of litigation. An increasingly popular alternative is the use of mediation and arbitration. A survey conducted by Cornell University showed that 88% of 1,000 of the largest US corporation are using mediation and 79% are using arbitration to resolve workplace disputes. Cornell’s findings indicated that the use of Alternative Dispute Resolution (ADR) is widespread and likely to grow significantly in the near future.
This workshop will cover:
- What the advantages are of using mediation vs. arbitration;
- Why mediation works;
- When is mediation not appropriate to use;
- What are the steps of the mediation process;
- How to use a mediator checklist; and
- How to facilitate the process.
You will also learn how to assist disputants to reach an agreement that is mutually satisfying. This workshop is highly interactive and will focus on role playing and cultivating the skills necessary in ADR and mediation.
